The Iberia Images website is part of The Resident Group.
The Iberia Images website provides access to a number of services that may only be used in accordance with these Terms & Conditions. The services include: -
• The ability to upload digital images to the website or to email digital images to Iberia Images so that we can upload them to the website on your behalf.
• The ability to order prints of digital images or digital copies of images that have been uploaded to the Iberia Images website for sale / syndication by photographers both amateur and professional or images submitted by the Algarve Resident newspaper for sale / syndication.
• These Terms & Conditions govern the relationship between you (The Client) and Iberia Images. The Iberia Images website, and the services provided through its website, can only be used if you agree to these Terms & Conditions. The Iberia Images website may only be used in accordance with these Terms & Conditions.
• Submission of photographs to Iberia Images for its use, publication, promotion, syndication and re-sale constitutes a contract and as such, Iberia Images will deem that all Terms & Conditions as stipulated in this section have been read, understood and agreed.
• Requesting or completing the purchase of photographs from Iberia Images constitutes a contract and as such, Iberia Images will deem that all Terms & Conditions as stipulated in this section have been read, understood and agreed.
• Only persons aged eighteen years or over may agree to these Terms & Conditions and purchase images from the Iberia Images website or use services offered by Iberia Images or through the Iberia Images website.
• These Terms & Conditions may be modified at any time without prior notice. We will post the modified Terms & Conditions on the Iberia Images website. The modified Terms & Conditions will come into effect as soon as they are posted on the Iberia Images website and the use of the website, or of any services provided through the website, after that point will be subject to the modified Terms & Conditions.
• If you do not agree with the Terms & Conditions as stipulated in this section, please discontinue your usage of the website.
Registration
• You must be registered with Iberia Images in order to purchase images or services but not to browse the website. Once your registration has been accepted you will be allowed, subject to the restrictions contained in these Terms & Conditions, to upload images to the website, to email images to us to upload to the website on your behalf and, subject to agreeing to any additional terms applying to them, request services to be supplied by Iberia Images, such as the printing of images uploaded or emailed by you or on your behalf, or by Iberia Images.
• You will have to enter your email address in order to register. Your email address will help us to verify your identity on future visits. In the event that you register using a non-existent email address or an email address that belongs to someone else, Iberia Images may terminate your registration without notice.
• There is no charge for registering with Iberia Images.
• There may be charges for other services supplied by us. These will be notified to you at the time you request the services. When you place an order for goods or services, including printing services, you will need to pay using your credit card which is handled securely through our online banking service. Any charges for the services requested will be billed to your credit card once the order has been accepted.
• In the event that you give details of a non-existent credit card or the number of a credit card that belongs to someone else, we reserve the right to terminate your registration without notice. In these instances, your order will not be fulfilled.
• As a registered user of Iberia Images, you can, using the same registration details, access the Algarve Resident newspaper website and the Portugal Blue Pages online business & services directory. If you are already a registered user of one of these websites, you will not need to re-register, but will have to agree to these Terms & Conditions before using the services offered within.
• eBulletin is an online newsletter which is periodically sent electronically to registered users of one of our companies or partners websites. As a registered user, you will automatically receive eBulletin. eBulletin is designed to give special information to those who have registered with one of our websites and in most cases contain notifications of special offers only applicable to registered online users. If you do not wish to receive eBulletin, please click on the ”unsubscribe” link at the bottom of the first newsletter you receive and you will discontinue to receive eBulletin. This will in no way affects your statutory rights, your registration of Iberia Images or any future business you may do or wish to do with this or our partner company.
Images
• You may upload digital images to the Iberia Images website yourself or email them to us to upload to the website on your behalf. Images uploaded to the Iberia Images website or emailed to us for uploading must be digital images in jpg format.
Image Use
• Images from this website can be purchased for “Commercial use ” or “non-commercial private use”. Prices and sizes are detailed in our Ordering section.
• Images purchased for “non-commercial private use” entitles you the right to use the image one-time, privately / personally, but does not allow through these Terms & Conditions the right to distribute to either friends, family, acquaintances or third-parties, or to publish in any publication either printed or electronic including blogs, chat rooms or forums either paid-for or free-of-charge, to sell or offer for sale, the images purchased from Iberia Images.
• Images purchased for “Commercial use” entitles you the right to one-time, world-wide, non-exclusive use of an image as a printed photograph, or for a website page or for one conventional publication (the name of which must be supplied when purchasing. Purchasers agree that images may be used once only with the agreement of the copyright holder. Extended use of the images is by prior permission only. The Copyright of the image remains with Iberia Images and the Intellectual Rights remain with the photographer.
What you are not allowed to do
• You are not allowed to copy, whether by printing off onto paper, storing on disk or in any other way, distribute, including distributing copies, alter or tamper with in any way or otherwise use any material contained in the Iberia Images website without written permission.
• You are not allowed to use the Iberia Images website, or to copy or use any material from the Iberia Images website, for any commercial purpose other than to conduct a commercial transaction with Iberia Images.
• You are not allowed to remove any copyright, trade mark or any other intellectual property rights notices contained in the original material from any material copied or printed off from the Iberia Images website.
• You are not permitted to register multiple times for use by the same person unless specifically authorised to do so by us in writing. Violation of this clause may result in suspension of your service.
• You must keep your password secure at all times. You will be responsible for any damage caused by unauthorised access resulting from your failure to keep your password secure.
• You will indemnify us and our officers and employees against any action, claim, damages, liability, costs and expenses arising out of:-
...any use of the Iberia Images website by you that is in breach of these Terms & Conditions;
...any claim that the uploading or emailing of any images by you or on your behalf is an infringement of any third party's copyright, trade mark or other intellectual property rights;
...any claim that the processing, printing or other dealing with by us in accordance with these Terms & Conditions of any images uploaded or emailed by you or on your behalf is an infringement of any third party's copyright, trade mark or other intellectual property rights.
Operation of the Website
• We may change the format, the images and content of the Iberia Images website, or any products or services offered by this website, at any time.
• We may terminate or suspend the operation of this website, or terminate or suspend provision of any products or services offered via this website, for support or maintenance work, in order to update the content or for any other reason. We may do this at any time and without prior notice.
Data Protection
Personal data provided to us through the Iberia Images website will only be used in accordance with our ”Privacy Policy” and in accordance with the Data Protection Act. Please read this carefully before proceeding. By providing your personal data to us you are consenting to its use in accordance with our privacy policy.
Services / Products
• Once you have placed an order for goods or services via this website, including any order for printing services, the order will not be treated as having been accepted until you receive confirmation from us that this is the case. This confirmation will be by email.
• The decision as to whether to accept an order is at our discretion and we are not legally bound to do so.
• To maintain continuity of service we reserve the right to use alternative photographic paper products in the production of prints, to those stated on the Iberia Images website.
• Free prints may be offered from time to time as part of a promotion or competition. Qualifying sizes for free prints are 6" x 4". Free prints can only be claimed as part of an online order through this website. Postage and packing charges will still apply and will need to be paid by credit or debit card or from your account, unless otherwise stated.
• Offer codes may be published from time-to-time as part of a promotion. Offer codes may provide a number of free prints or a discount on part of an order. Offer codes can only be used for online orders placed through this website. A maximum of one offer code can be specified per order. Unless otherwise specified, postage and packing charges will still apply to orders subject to an offer code. Further conditions may apply and if so will be published with the relevant offer code.
• We will use our reasonable endeavours to reply promptly to all correspondence. Such reply will be by email.
Termination
• You may terminate your registration by contacting us via email or post – see our Contact section for details. You may be asked to provide further proof that you are the holder of the registration. Your registration will be terminated as soon as reasonably practicable following receipt of your email or letter.

If you wish to remain anonymous, please inform us at the time of submission. Iberia Images may request information as to the request of anonymity to prove intellectual rights and copyright permissions for images being submitted for re-sale or syndication.
